Judge rules surrogate mother keeps child
Jacksonville, Florida - A Jacksonville judge has ruled that an Oviedo couple are not the legal parents of a baby they hired a surrogate mother to bear.
The decision leaves the infant with a Jacksonville woman.
Tom and Gwyn Lamitina's attorney says they will appeal the ruling. The couple had a falling out with the surrogate mother before the baby was born in May. The woman then sued Tom Lamitina, seeking custody and child support. The judge ruled that under Florida law, Tom Lamitina is merely a sperm donor, and not the baby's father, and therefore not required to pay child support.
According to state law, a pregnant mother giving up her child for adoption can change her mind at any point, even 48 hours after giving birth.
